1. Who these terms are between

These General Terms and Conditions (the “Terms”) govern your use of the JustSame — Look Alike app (“JustSame”, the “App”), operated by dimix.it di Dimitri Giani, Largo Riviera 7, Tirrenia, Pisa (Italy), VAT IT02381200506 (“we”, “us”). You are the “User”.

By installing and using the App you accept these Terms. If you do not accept them, please do not use the App.

2. What the App does

JustSame lets you compare two photos of faces and returns a similarity score from 0 to 100%, broken down across five facial areas, together with a short comment. No registration or account is required.

The result is produced by an automated analysis and is provided for entertainment only. It is not a biometric identification, a paternity or kinship test, a medical or genetic assessment, or evidence of anything. Do not use it to make decisions that matter.

3. JustCoins and purchases

• Running one comparison costs one JustCoin. You receive one JustCoin free when you first open the App.
• Further JustCoins are bought through in-app purchases in packs, at the prices shown in the App at the time of purchase. There is no subscription.
• JustCoins are a consumable digital item with no monetary value. They cannot be exchanged for money, transferred to another person, or refunded once spent.
• All purchases are made and processed by Apple through the App Store under Apple's own terms. Your payment details are handled by Apple, never by us.
• Refund requests are therefore handled by Apple, at reportaproblem.apple.com.
• Your balance is tied to the Apple ID used for the purchase. Reinstalling the App or changing device does not destroy purchased JustCoins — use Restore purchases.
• We may change prices or run temporary promotions. A change of price gives no right to a refund on purchases already made.

Right of withdrawal. Under Art. 59(1)(o) of the Italian Consumer Code, by starting to use JustCoins immediately after purchase you ask for the service to begin at once and acknowledge that you lose the statutory 14-day right of withdrawal for the coins you have already spent.

4. Who can use JustSame

You must be at least 14 years old to use the App, in line with Italian law on the age of digital consent. By using it you confirm you meet that condition and that you have the legal capacity to accept these Terms.

5. Your responsibilities with photos

You confirm that, for every photo you compare, you either are the person shown or have the right to use that image and the agreement of the person shown. You must not upload images that are unlawful, that infringe someone else's rights, or that depict minors in any inappropriate way.

You also agree not to misuse the App: no attempts to break, overload, reverse engineer or automate it, no scraping, no reselling of the service, and nothing that breaks the law.

If you breach this section, you agree to hold us harmless from claims and reasonable costs arising from it.

6. What we do with the photos

We use the two photos solely to produce your result, and we do not store them. We claim no ownership of your images and no licence to use them for promotion or any other purpose. The details are in the Privacy Policy.

7. Availability and changes

We try to keep JustSame working, but we do not guarantee that it will be available without interruption or free of errors, nor that any particular result will be accurate. We may modify, suspend or discontinue the App or any of its features, and we may update these Terms — the current version is always the one published on this page, with its date.

If a change to these Terms is material, we will flag it in the App. Continuing to use JustSame after a change means you accept it; if you do not, please stop using the App and uninstall it.

8. Liability

Nothing in these Terms limits our liability for wilful misconduct, gross negligence, death or personal injury, or any liability that cannot be excluded under Italian law — including the mandatory rights that consumer law gives you.

Beyond that, we are not liable for indirect or consequential losses arising from your use of the App, for decisions you take on the basis of a similarity score, for interruptions caused by events beyond our reasonable control, or for the content of third-party websites linked from the App.

9. Intellectual property

The JustSame name, logo, design, software and algorithms are ours and remain ours. Using the App gives you a personal, non-transferable, revocable right to use it as intended, and nothing more. You may not copy, modify, decompile or redistribute any part of it except where the law expressly allows it.

10. Ending the relationship

You can stop using JustSame at any time by uninstalling it. We may suspend or block access if you breach these Terms, in particular sections 4, 5 and 9.

Sections 5, 8, 9 and 11 survive the end of these Terms.

11. Applicable law and jurisdiction

These Terms are governed by Italian law.

If you are a consumer, you keep the protection of the mandatory rules of the country where you live, and any dispute may be brought before the court of your place of residence or domicile. If you are not acting as a consumer, the courts of Pisa (Italy) have exclusive jurisdiction.

Consumers resident in the EU may also use the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr.

12. Miscellaneous

If a provision of these Terms turns out to be invalid, the rest stays in force and the invalid part is replaced by the valid provision closest to its purpose. Our failure to enforce a right is not a waiver of it. You may not assign these Terms to anyone else.

13. Clauses requiring specific approval

Pursuant to Articles 1341 and 1342 of the Italian Civil Code, the User declares to have read and to specifically approve the following clauses: 3 (JustCoins and purchases), 5 (Your responsibilities with photos), 7 (Availability and changes), 8 (Liability), 10 (Ending the relationship) and 11 (Applicable law and jurisdiction).
